However, the grand jury system is not without controversy and questions about its fairness and transparency have been raised.One of the biggest issues with the grand jury system is the prosecutor's control over the proceedings. As Steve notes, the prosecutor has control over the proceedings and can present the case in a way that incorporates obvious defenses to prevent an indictment. This means that defendants do not have the same rights they would have in a trial by jury within a courtroom. For example, defendants do not have the right to appear in front of a grand jury and testify in their own case. While some prosecutors may invite defendants to testify, it is not a guaranteed right.However, witnesses can be subpoenaed to testify in front of a grand jury and have the right to an attorney. The attorney cannot be present in the grand jury room but can advise the witness outside the room and the witness can assert their Fifth Amendment right to remain silent if their responses may incriminate them. This is an important protection for witnesses who may be intimidated or coerced into providing false or misleading testimony.Another issue with the grand jury system is its secrecy. As Steve points out, grand jury proceedings are done in secret and are not a trial by jury within a courtroom. While this secrecy is meant to protect the integrity of the investigation, it also means that defendants and their attorneys do not have access to the evidence presented to the grand jury. This lack of transparency can make it difficult for defendants to mount an effective defense and can contribute to a perception of unfairness.Despite these concerns, grand juries have enormous power, particularly on the federal level, and can issue subpoenas for information and testimony. This power has been used in high-profile cases, such as the investigation into Russian interference in the 2016 presidential election. However, the grand jury system remains controversial and questions about its fairness and transparency are likely to continue.The grand jury system is an important aspect of the American criminal justice system, but it is not without controversy. The Litigation Psychology Podcast – Episode 161 – Humanizing the Corporate Defendant Dr. Steve Wood discusses the topic of humanizing the corporate defendant. The data doesn’t support that making the argument to jurors that the corporation is made up of regular people who just go to work and try to do their best. Mock trials and actual trials have consistently demonstrated that jurors see through these arguments and don't buy into this. Jurors also discount arguments made about how the company supports other worthy causes, recognizing that those charitable contributions are tax write-offs and calling those actions out as insincere or tainted. 
Based on all this, what can be done to humanize the corporate defendant?
1) Work with your corporate representatives by getting them involved early to ensure they are prepared for trick questions in deposition, present well at deposition and trial, and that their testimony and demeanor is credible; 
2) Have a plan for communicating in a crisis. Work with an experienced crisis management and crisis response team to define the narrative of the incident and the company's response. A strategic and thoughtful crisis communication response can defend and even bolster the reputation of the company even before the possibility of litigation arises; 
3) Get an idea of anti-corporate bias in jury selection by asking more insightful voir dire questions and digging deeper into juror attitudes, beliefs, experiences, and personalities to identify explicit or implicit biases; 
4) Make a plan to address head-on the topic that plaintiff's counsel will bring up about your client valuing profits over safety; 
5) During trial, be cognizant of how the corporate rep is behaving and the impression the corporate rep is giving the jury, even while they are just sitting at the defense table. 
Humanizing the corporate defendant is possible, but it requires a deliberate approach and being aware of juror perceptions throughout the entire litigation process.

Should Your Law Firm Run Without You? Is it realistic for a law firm owner to strive for a law firm that runs without them? Jim and Tyson have changed their thinking around this topic of a law firm owner working towards the goal of being only in the owners box. Is this possible? It’s an interesting idea, however, we don’t think it's really possible for a law firm owner to be in the owners box only and run a highly successful firm that you can scale. You probably could get most of the way there, but the nature of what we do requires that we be deeply integrated into the firm. There are some exceptions but not many in today's world, and we don't think it's realistic to expect that you are going to be in the owners box and be able to just let the firm run itself. 'Spreading the gospel of arbitration in Africa' – John Ohaga S.C. CArb, FCIArb In this podcast, John Ohaga, managing partner at TripleOKLaw Advocates, based in Nairobi, Kenya, chats to Africa Legal’s Tom Pearson about Africa becoming a renowned seat for arbitration.

Widely recognised in Africa and globally for his exemplary work and expertise in dispute resolution, Senior Counsel John Ohaga is well respected when it comes to all things arbitral related.

Ohaga, who holds an impressive CV, credits updated arbitration legislation, trained and certified arbitrators, as well as the growth of arbitration institutions in many African countries for having contributed to the utilisation and awareness of arbitration as a dispute resolution mechanism.

He says, given the opportunity, African arbitrators can provide the same skill set and quality of service as their Western and Eastern counterparts.

“Practitioners in Europe and the Americas and perhaps across Singapore and Hong Kong have great opportunities to practise arbitration on a more frequent basis and therefore hone their skills. It also means that arbitration institutions are better able to fund the acquisition of infrastructure to have better hearing rooms and other facilities that would make holding an arbitration hearing comfortable, efficient and effective. Africa is playing catch up, because we do not have the same opportunities that practitioners in those jurisdictions have.”

Ohaga maintains that there should be a medley of stakeholders who advocate for using an African centre for arbitration.

He uses Kenya as a successful example, where the former attorney general issued a memorandum that required every state corporation entering a contractual relationship, to designate the Nairobi Centre for International Arbitration as the institution under whose auspices a dispute would be governed in the event any occurred. This move shines the spotlight on the country as a venue and then a seat.

Ohaga, who was recently appointed to the board of the International Council for Commercial Arbitration (ICCA), says his role is mainly to promote African arbitration and ensure that the ICCA establishes a greater presence on the continent so that it can be globally aligned.

He goes on to advise on how one can become a member of ICCA and how another organisation, the African Arbitration Academy, is training the next generation of arbiters.

The conversation wraps up with Ohaga discussing key trends that are shaping the future of commercial arbitration, and how the jurisprudence that flows out of courts can define whether or not Africa will be considered a safe seat.

Jeff pushed his way through a sea of Masih’s supporters and introduced himself to her, the purported victim of his client who was there to give a statement at sentencing. Jeff’s career has some interesting days, and this was one of them.

Episode 269 – Onslaught of the Orchestras The Battle of the Bands was fought on the morning of July 12, 1862. As the Union drummers bombarded the enemy positions, a detachment of light guitarists moved up the side of Hendrix Hill and broke through the right flank. The Confederate keyboardists met this charge with an earsplitting synth melody, leading to heavy casualties as the guitarists were scattered. In the end, the winner was neither the Union nor the Confederates, but was the local high school group Punch Force for their incredible power ballad Eat My Love Hoagie.
