In today's episode, Professor Miller talks with Ruth Bader Ginsburg, associate justice of the United States Supreme Court. In the first episode, Professor Miller and Justice Ginsburg discussed their overlapping journeys in the law and what Justice Ginsburg considered to be the most important change in the law and the courts that she has witnessed so far during her career. In this second of our two part interview, Professor Miller and Justice Ginsburg discussed what makes for an effective argument before the Supreme Court, and Professor Miller asks Justice Ginsburg her thoughts on the Academy Award winning documentary about her life and how it feels to have become a cultural icon as a Supreme Court justice. Uh, people listening to us talk are basically lawyers. Most of them. Let's give them an insight or two. What makes for a good CERT petition? Thousands of petitions come in on Lee. A few were chosen. Shorter is better, shorter shows. You have confidence that your issue is worthy of review. So I would say separatists in the zeroes in on what is the burning issue in this case, and doesn't try to include peripheral issues that are unlikely to attract a vote to grant review so security that you have an issue that the court should here when I pick up, whether it's a sir, partition or brief lawyers tend to fill the space allotted. And no matter how we limit the number of words, Lorries will somehow reach just that limit. But in truth, shorter is better. But one thing. The chance that justice will read every page. If you're sir, petition if you breathe shorter, is vastly enhanced if you write short. If you write long, well, then you can count on the justice to read the summary of argument and rely on the rockers to summarize the rest of it. So, keeping it short, I think it's good advice and keeping it shop and clear. One test that I had in the days when I was writing petition was to read aloud, and if any sentence requires you to re read it in order to grasp what is being conveyed, that sentence should be taken out and broken down so that what the justice reads is easily digestible. She doesn't need to read that because she's got it. First time
